2. Products
Neutral & Natural Audio publishes audio software delivered exclusively by electronic download, without physical medium. These are digital content products not supplied on a tangible medium, within the meaning of Article L221-28 13° of the French Consumer Code.
- PHON, a standalone monitor controller application for macOS.
- AudioBridge, an audio routing plugin in VST3, AU and CLAP formats for macOS.
- NNA Virtual Audio, a virtual audio driver for macOS, supplied free of charge.
The system requirements of each product are stated on its product page and apply as published on the day of purchase.
3. Free Trial
A free trial of 14 days is offered before any purchase. The trial provides access to all features of the software without restriction and without requiring payment information. This trial period allows the customer to fully evaluate the product's compatibility and suitability before buying.
4. Price, VAT and Payment
Prices are displayed in euros and include VAT. The displayed price is the total amount payable; no additional fee is added at checkout.
Payment is processed by Stripe Payments Europe, Ltd. The seller does not collect or store payment card details.
The price is a one-time payment granting a personal, non-exclusive, non-transferable licence to use the software without time limitation. One licence allows activation on up to 2 machines.
5. Right of Withdrawal
The rule: under Article L221-28 13° of the French Consumer Code and Article 16(m) of EU Directive 2011/83/EU, a consumer loses the 14-day right of withdrawal for digital content not supplied on a tangible medium only where performance has begun with their prior express consent and their express acknowledgement that they thereby lose that right.
How this applies to your order:
- Where the checkout asks you to confirm that you request immediate delivery of the licence key and acknowledge losing your right of withdrawal, that consent is recorded with your order and the right of withdrawal no longer applies once the key has been sent.
- Where you were not asked to give that confirmation before payment, you keep your 14-day right of withdrawal from the date of purchase. Write to support@neutralandnaturalaudio.com to exercise it and you will be refunded within 14 days of the seller being informed.
The 14-day free trial is offered precisely so that compatibility and suitability can be checked before any payment is made.
6. Delivery
Upon payment confirmation, the customer receives an email containing:
- The licence key
- A download link for the purchased software
- Activation instructions
Delivery is immediate in normal operation and in any event within 30 days. If the email does not arrive, check the spam folder and contact support.
7. Activation
The licence is activated inside the application, or inside the plugin for AudioBridge, using the email address and licence key provided at purchase. An internet connection is required for activation. The customer may manage activations from their customer panel.
8. Professional Customers
The right of withdrawal provisions in these terms apply exclusively to consumers as defined by EU law. Purchases made for professional purposes are not subject to the right of withdrawal.
9. Intellectual Property
The software is protected by copyright law. The customer is granted a licence to use the software; no ownership of the intellectual property is transferred. Redistribution, reverse engineering, or modification of the software is prohibited.
10. Legal Guarantee of Conformity
Consumers benefit from the legal guarantee of conformity for digital content under Articles L224-25-12 et seq. of the French Consumer Code, and from the guarantee against hidden defects under Articles 1641 et seq. of the French Civil Code. These guarantees apply independently of any commercial warranty and are not limited by these terms.
Where the software is supplied as a one-off act of supply, the guarantee of conformity applies for two years from delivery. To make a claim, describe the problem to support@neutralandnaturalaudio.com; a non-conforming product will be brought into conformity at no cost, and failing that the price will be reduced or refunded.
Beyond these legal guarantees, the seller's liability is limited to the price paid for the software. The seller is not liable for indirect damage, loss of data or loss of session work; customers are advised to keep backups of their projects as they would with any audio software.
11. Consumer Mediation
In case of dispute, the customer should first contact the seller at support@neutralandnaturalaudio.com, who undertakes to answer within 5 working days.
If no resolution is reached, the consumer may refer the matter free of charge to a consumer mediator in accordance with Articles L611-1 et seq. of the French Consumer Code. The seller is currently completing its membership of an approved mediation scheme; the mediator's name, postal address and website will be published in this clause as soon as that membership takes effect. In the meantime the list of approved mediators is published by the French Commission for the Evaluation and Control of Consumer Mediation (CECMC) at economie.gouv.fr/mediation-conso.
12. Personal Data
The email address collected during purchase is used solely for licence delivery, activation and customer support. Processing, retention periods, the list of processors and your rights under the GDPR are described in the Privacy Policy. You may request access, rectification or deletion of your personal data by writing to support@neutralandnaturalaudio.com.
13. Applicable Law
These terms are governed by French law. Consumers resident in the European Union also enjoy the mandatory protections of the law of their country of residence, and may bring proceedings before the courts of that country. Nothing in these terms deprives a consumer of a right they hold under the law applicable to them.
